These Términos del Servicio ("Terms") form a legal agreement between you and Tradesera ("Tradesera", "we", "our", or "us") and govern your use of our websites, applications, simulated trading challenges, and related services (collectively, the "Services").

1. Acceptance of Terms

By accessing or using the Services, you agree to these Terms and our Política de Privacidad. If you do not agree, do not use the Services.

2. Eligibility

• You must be at least 18 years old and legally able to enter binding contracts.
• You must provide accurate and complete account information.
• You are responsible for compliance with laws applicable to your jurisdiction.
• We may deny or terminate access for compliance, sanctions, risk, fraud, or abuse reasons.

2A. Disponibilidad geografica y jurisdicciones restringidas

Durante beta, Tradesera esta disponible solo para residentes de Estados Unidos. Tradesera no acepta participacion de personas o entidades que Tradesera o sus proveedores no puedan apoyar legalmente o de forma segura, incluyendo personas, entidades, paises, regiones o actividad sujeta a sanciones de EE. UU., restricciones OFAC, preocupaciones FATF de alto riesgo o monitoreo incrementado, restricciones de proveedores de pago, limites de verificacion de identidad, limites de documentacion fiscal o limites de proveedores de payout.

Tradesera puede negar registro, restringir acceso, cerrar cuentas, colocar retenciones de wallet o payout, negar elegibilidad de retiro o requerir revision adicional si su ubicacion, residencia, ciudadania, identidad, perfil fiscal, metodo de pago, metodo de payout, uso de VPN/proxy, revision de sanciones o revision AML/KYC no puede verificarse o apoyarse.

3. Simulated Trading Nature

Unless expressly stated otherwise in a separate written agreement, activity on Tradesera challenge accounts is simulated and educational in nature. Simulated balances are not bank deposits, are not brokerage accounts, and do not represent ownership of actual market positions. Tradesera does not custody customer investment funds.

Trading and trading-related activity involve substantial risk. Past or simulated results are not guarantees of future performance. Tradesera does not provide investment, tax, accounting, or legal advice. You are solely responsible for your own decisions.

5. Account Security

• You are responsible for safeguarding account credentials and session access.
• You must notify us promptly of unauthorized use or suspected compromise.
• Accounts may not be sold, rented, shared, or transferred without written authorization.
• Unless expressly allowed, one person may not operate multiple accounts to evade rules.

6. Fees, Billing, and Refunds

• Challenge or subscription fees are charged according to pricing shown at checkout.
• Payments are processed by third-party providers and may be subject to their terms.
• Current billing details and payment method disclosures are listed on our Payments & Billing page.
• Refund treatment is governed by our Política de Reembolsos and any challenge-specific terms.
• We may update pricing, offers, and plans prospectively.

7. Challenge Reglas and Enforcement

Each challenge includes rules covering items such as contract limits, drawdown limits, minimum activity, eligibility criteria, and payout requirements. You agree to follow all published challenge rules.

If there is a conflict between these Terms and a specific challenge rules page, the challenge rules page controls for that challenge.

8. Prohibited Conduct

You agree not to misuse the Services, including by:

• Fraud, misrepresentation, identity abuse, or chargeback abuse.
• Attempting to bypass challenge rules, account controls, or risk constraints.
• Manipulative, disruptive, or abusive trading behavior as determined by us in good faith.
• Use of tools or automation intended to exploit platform errors, latency, or technical loopholes.
• Harassment, threats, hate speech, or abusive communication toward staff or users.
• Any unlawful activity, including attempts to access systems without authorization.

9. Monitoring and Actions

We may monitor account activity, logs, and platform interactions for security, compliance, quality, and fraud prevention. If we believe rules or Terms are violated, we may take actions including warnings, trade/result adjustments, account restrictions, payout holds, suspension, or termination.

10. Payout Eligibility and Review

Payouts are discretionary based on compliance with challenge rules, settlement status, payment review, fraud screening, and other operational controls. Estimated timelines are not guaranteed and may vary.

11. Intellectual Property

The Services, including software, designs, text, graphics, logos, interfaces, and related materials, are owned by Tradesera or its licensors and protected by applicable intellectual property laws. You receive a limited, revocable, non-transferable license to use the Services for personal, non-commercial use, subject to these Terms.

12. User Content and Community Areas

If you post content in community channels or interactive areas, you are responsible for that content and represent that you have the right to post it. You grant us a non-exclusive license to host, display, and use that content to operate and improve the Services.

13. Third-Party Services

The Services may contain links or integrations with third parties, including payment, communication, data, and analytics providers. We are not responsible for third-party services, websites, or policies.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADESERA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 30 DAYS BEFORE THE CLAIM, OR (B) USD $100.

16. Indemnification

You agree to defend, indemnify, and hold harmless Tradesera and its affiliates, officers, employees, contractors, and suppliers from claims, liabilities, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

17. CFTC Rule 4.41 Disclosure

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE LIMITATIONS. UNLIKE ACTUAL PERFORMANCE, SIMULATED RESULTS DO NOT REPRESENT REAL TRADING. RESULTS MAY UNDER OR OVER COMPENSATE FOR MARKET FACTORS SUCH AS LIQUIDITY. NO REPRESENTATION IS MADE THAT ANY ACCOUNT WILL ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.

18. Governing Law, Venue, and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. To the extent permitted by law, disputes will be resolved exclusively in state or federal courts located in Florida, unless we elect arbitration in a specific matter.

Where permitted by law, you and Tradesera waive jury trial and class action participation for disputes arising from or relating to these Terms.

19. Time Limit for Claims

To the extent permitted by law, any claim arising out of or related to the Services or these Terms must be filed within one (1) year after the claim arises, or it is permanently barred.

20. Suspension, Termination, and Survival

We may suspend or terminate access to the Services at any time for business, legal, security, or Terms-related reasons. Provisions that by nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnification, and dispute provisions.

21. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted. Continued use of the Services after updates means you accept the revised Terms.
